Terms of Service

These Terms of Service ("Terms") govern your use of Over-N-Out (the "Service"), a real-time push-to-talk communication app provided by DadPro Technologies ("we," "us," "our"). By installing, accessing, or using Over-N-Out, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Over-N-Out is a push-to-talk ("PTT") voice communication app. Users join named "wires" (channels) to transmit and listen to voice in real time. The Service also includes optional features such as on-device speech-to-text captions, friend lists, owned wires, and group invitations.

Voice transmissions are streamed in real time and are not recorded or stored on our servers. Captions are generated on your device and are not transmitted to us or to any third party.

2. Eligibility

You must be at least 13 years old to use Over-N-Out. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service.

The Service is not intended for use as a primary communication system for life-safety, emergency response, medical, or mission-critical operations. Do not rely on Over-N-Out for emergency communications. Always use 911 (or your local equivalent) in an emergency.

3. Anonymous Use and Accounts

You may use Over-N-Out anonymously without creating an account, subject to these limits: up to 5 participants per wire, up to 10 friends, and up to 3 recent wires.

To unlock additional features (owned wires, closed wires, larger groups, friends sync, push notifications), you may create an account using email and password or Sign in with Apple. You are responsible for keeping your account credentials confidential and for all activity under your account.

You agree to provide accurate information when creating an account. You may not impersonate another person, register on someone else's behalf without authorization, or use a callsign that is offensive, infringes on a third party's rights, or is otherwise prohibited.

4. Subscriptions and Payments

Personal tier — $1.99/month USD (or local equivalent). Subscriptions are billed through Apple's App Store and auto-renew at the end of each billing period unless you cancel at least 24 hours before renewal.

Cancellation and refunds. You can cancel anytime via your iPhone Settings → [Your Apple ID] → Subscriptions. Refunds are handled by Apple under Apple's refund policy. We cannot issue refunds directly.

Price changes. We may change subscription prices at any time. Price changes apply to renewals after the change takes effect; we will notify you in advance through the App Store or in-app.

Team and Organization tiers. Larger team accounts are available by request. Pricing, billing, and seat management for team accounts are arranged directly with us — contact support@overnoutapp.com.

You agree that you will not:

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

6. Wire Ownership and Closed Wires

Active Personal-tier subscribers may claim ownership of one wire name (subject to availability — names are first-come, first-served).

Wire owners' responsibilities. As a wire owner, you control who can join your wire (via direct approval, invites, or denial). You are responsible for managing membership and removing users who violate these Terms or your community's standards. We do not moderate user-claimed wires.

Loss of wire ownership. If your subscription lapses, your wire claim becomes available for other users to claim. We are not responsible for wire-name disputes between users.

7. User Content

Voice transmissions are ephemeral and are not stored on our servers. Other content you submit (your callsign, friend list, wire memberships) is stored on our servers in order to provide the Service.

You retain ownership of any content you create. By using the Service, you grant us a limited license to transmit, route, and process your content as necessary to operate the Service.

8. Third-Party Services

Over-N-Out relies on third-party services to operate, including Apple (authentication, in-app purchases, push notifications), Supabase (database and serverless functions), and Hetzner (server hosting for our voice infrastructure). Your use of the Service is also subject to those providers' terms where applicable.

9. Service Limits and Availability

Auto-Disconnect Behavior

To conserve device resources and infrastructure, Over-N-Out will automatically disconnect you from a wire under the following conditions:

Auto-disconnect is especially relevant for always-on use cases such as security monitoring. If uninterrupted connection is critical to your use case, monitor the app periodically.

Wire Captions Accuracy

Wire Captions uses on-device automated speech recognition to transcribe voice transmissions. Wire Captions will contain errors. Transcription accuracy varies based on audio quality, speaker clarity, accents, background noise, and device capability. No guarantee of accuracy is made or implied.

Wire Captions is provided as an accessibility aid only. It must not be relied upon as the sole means of receiving safety-critical, medical, legal, or time-sensitive communications.

Background Audio

Over-N-Out uses a background audio session to maintain connectivity when the app is not in the foreground. iOS may terminate background processes under memory pressure. We cannot guarantee continuous background operation on all devices or iOS versions.

You may stop using the Service and delete your account at any time. We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. On termination, your right to use the Service ceases immediately. Subscription billing rules continue to apply through the end of any paid period.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app or via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

If you are a resident of the European Union or United Kingdom, the laws of your country of residence may also apply, and you may bring claims in the courts of your country of residence as required by applicable consumer-protection law.

16. Intellectual Property

Over-N-Out, including its name, logo, and design, is owned by DadPro Technologies. You may not reproduce, distribute, or create derivative works without permission.
